These Terms and Conditions govern the use of the YEESTHIN online store available at www.yeesthin.com, as well as distance sales contracts concluded between the Seller and its Customers.

By using the Website and/or placing an order, the Customer confirms that they have had the opportunity to review these Terms and Conditions before entering into the contract.

These Terms and Conditions do not restrict any consumer rights granted under applicable European Union law or mandatory national consumer protection legislation.

Hereinafter, the company may be referred to as “YEESTHIN”, the “Seller”, “we”, “us” or “our”.

2. SCOPE OF THESE TERMS AND CONDITIONS

2.1. These Terms and Conditions apply to distance sales contracts concluded through www.yeesthin.com.

2.2. YEESTHIN primarily offers tea, herbal products, cosmetic products and related goods.

2.3. A “Consumer” means a natural person who purchases goods for purposes outside their trade, business, craft or professional activity.

2.4. Where a Customer purchases goods as part of their trade, business or professional activity, certain rights granted specifically to consumers, including the statutory right of withdrawal, may not apply.

2.5. In the event of any conflict between these Terms and Conditions and a mandatory provision of applicable consumer protection law, the mandatory provision shall prevail.

3. PRODUCTS AND PRODUCT INFORMATION

3.1. YEESTHIN makes reasonable efforts to ensure that the information, descriptions, images, ingredients, quantities and characteristics of products displayed on the Website are accurate and up to date.

3.2. Product images are for illustrative purposes. Minor differences in colour, packaging, labelling or other non-essential characteristics may occur, provided that such differences do not alter the nature, intended use or quality of the product.

3.3. For food products, including teas, YEESTHIN provides the food information required by applicable legislation to be made available before completion of the purchase.

3.4. Customers are responsible for reviewing the information concerning ingredients, allergens, directions for use, storage conditions and warnings, where applicable.

3.5. Information concerning teas, herbs, botanical extracts and other products on the Website is provided for informational purposes only and does not constitute medical advice, diagnosis or prescription.

3.6. Cosmetic products must be used in accordance with their intended purpose, directions for use and any warnings displayed on the product and/or its packaging.

3.7. YEESTHIN does not represent cosmetic products as having characteristics or functions that they do not possess.

4. PRICES, VAT AND CURRENCY

4.1. The price of each product is displayed on the relevant product page.

4.2. Prices displayed to Consumers include the applicable value added tax (VAT), unless expressly stated otherwise.

4.3. Depending on the country of delivery, the applicable VAT rate may be determined in accordance with the relevant European Union VAT rules.

4.4. The total price of the order, including applicable taxes and delivery charges, will be displayed to the Customer before the order is finally confirmed.

4.5. Delivery charges are not necessarily included in the displayed product price.

4.6. Delivery charges are calculated after the Customer enters the delivery address and are displayed in the cart or during checkout before the Customer confirms and pays for the order.

4.7. YEESTHIN may change product prices at any time. Such changes will not affect contracts already concluded or orders already confirmed.

4.8. In the event of an obvious technical pricing error that could reasonably be recognised as incorrect, YEESTHIN may contact the Customer to confirm the order at the correct price or cancel the order and refund any payment already received.

5. ORDERS AND CONCLUSION OF THE CONTRACT

5.1. The Customer places an order by selecting products, adding them to the shopping cart, providing the required delivery and payment information and finally confirming the order.

5.2. Before submitting the order, the Customer will have the opportunity to review the selected products, quantities, delivery address, prices, delivery charges and total amount payable.

5.3. By submitting an order, the Customer confirms that the information provided is accurate, complete and up to date.

5.4. After successfully submitting an order, the Customer will receive an electronic confirmation at the email address provided.

5.5. The sales contract is concluded once YEESTHIN accepts the order and sends confirmation to the Customer.

5.6. YEESTHIN may reject or cancel an order for objective reasons, including lack of stock, an obvious pricing or technical error, inability to deliver, suspected fraud or another lawful reason.

5.7. Where an order that has already been paid for is cancelled, YEESTHIN will refund the amount received without undue delay.

6. PAYMENT

6.1. Available payment methods are displayed during checkout and may vary depending on the Customer's country.

6.2. YEESTHIN may use external licensed payment service providers to process payments.

6.3. YEESTHIN does not store the Customer's full payment card details where payment is processed directly by an external payment service provider.

6.4. Where the selected payment method requires advance payment, the order may be processed after successful confirmation of payment.

6.5. In the event of a failed or declined payment, YEESTHIN is not required to dispatch the order until payment has been successfully completed.

7. DELIVERY

7.1. YEESTHIN delivers orders through international and national logistics providers, including but not limited to DHL, Deutsche Post, DPD and FedEx, as well as other appropriate courier or postal operators.

7.2. The specific carrier may be selected according to the destination country, delivery address, type of order and available logistics services.

7.3. Available delivery methods and the applicable delivery charge are displayed after the delivery address has been entered and before the order is finally confirmed.

7.4. Delivery times displayed on the Website are estimates unless a specific delivery date or period has expressly been agreed.

7.5. YEESTHIN will make reasonable efforts to hand orders over to the carrier in a timely manner.

7.6. Unless otherwise agreed, goods will be delivered without undue delay and within the maximum period prescribed by applicable law.

7.7. The Customer must provide a complete and accurate delivery address, name, telephone number and any other information necessary for delivery.

7.8. YEESTHIN shall not be responsible for delays or inability to deliver caused by incorrect or incomplete information provided by the Customer, failure by the Customer to provide reasonable assistance necessary for delivery, or other circumstances attributable to the Customer.

8. TRANSFER OF RISK

8.1. In sales to Consumers, the risk of loss of or damage to the goods passes to the Customer when the Customer or a third party designated by the Customer, other than the carrier, acquires physical possession of the goods.

8.2. Where the Customer independently appoints a carrier that was not among the delivery options offered by YEESTHIN, the risk may pass to the Customer when the goods are handed over to that carrier, to the extent permitted by applicable law.

9. UNDELIVERED AND UNCOLLECTED SHIPMENTS

9.1. The Customer must reasonably cooperate with the delivery process and monitor notifications and delivery information provided by the carrier.

9.2. Where delivery cannot be completed due to circumstances attributable to the Customer, including:

  • an incorrect or incomplete delivery address;
  • incorrect contact information;
  • failure to be present at the delivery address;
  • failure to collect the shipment from a parcel shop, locker, collection point or other designated location within the applicable collection period;
  • inability of the carrier to contact the Customer due to incorrect or outdated information provided by the Customer;
  • unjustified refusal to accept the shipment;

the shipment may be returned to YEESTHIN.

9.3. Failure to accept or collect a shipment does not, by itself, constitute a valid exercise of the statutory right of withdrawal.

9.4. Where a prepaid order is returned to YEESTHIN due to circumstances attributable to the Customer, YEESTHIN may refund the value of the goods after receiving them back and inspecting their condition. Direct and demonstrable costs resulting from the unsuccessful delivery and return may be deducted only to the extent permitted by applicable law.

9.5. If the Customer requests that an order returned due to circumstances attributable to them be dispatched again, YEESTHIN may require advance payment of the new delivery costs.

9.6. YEESTHIN shall not be liable for an inability or delay in delivery that is directly caused by the Customer's failure to provide accurate information or reasonable cooperation necessary to receive the shipment.

10. RIGHT OF WITHDRAWAL

10.1. A Consumer has the right to withdraw from a distance sales contract without giving any reason within 14 days, unless a statutory exception applies.

10.2. For the sale of goods, the 14-day withdrawal period begins on the day on which the Consumer or a third party designated by the Consumer, other than the carrier, acquires physical possession of the goods.

10.3. Where several goods ordered in one order are delivered separately, the withdrawal period begins upon receipt of the last item.

10.4. To exercise the right of withdrawal, the Consumer must inform YEESTHIN of their decision to withdraw by means of an unequivocal statement before the withdrawal period expires.

10.5. The Consumer may use the standard withdrawal form where one is made available on the Website, but use of that form is not mandatory provided that the statement otherwise clearly communicates the decision to withdraw.

11. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

11.1. The right of withdrawal does not apply in circumstances excluded by applicable law.

11.2. Subject to the statutory requirements being satisfied, these circumstances may include:

  • goods that are liable to deteriorate or expire rapidly;
  • sealed goods that are not suitable for return for reasons of health protection or hygiene and have been unsealed after delivery;
  • goods made to the Consumer's specifications or clearly personalised;
  • other categories for which applicable legislation expressly excludes the right of withdrawal.

11.3. For cosmetic products, whether an exception to the right of withdrawal applies will depend on the nature of the specific product, the manner in which it is sealed and the applicable statutory requirements.

11.4. Opening the external transport packaging alone does not automatically result in the loss of the right of withdrawal.

12. RETURNING GOODS

12.1. After notifying YEESTHIN of the withdrawal, the Consumer must send the goods back without undue delay and no later than 14 days from the day on which the Consumer communicated the decision to withdraw.

12.2. The return address and return instructions will be provided by YEESTHIN when the return is requested.

12.3. Unless YEESTHIN has expressly agreed to bear these costs or applicable law provides otherwise, the direct cost of returning goods following the exercise of the right of withdrawal shall be borne by the Consumer.

12.4. Returns sent on a cash-on-delivery basis will not be accepted unless this has been expressly agreed with YEESTHIN in advance.

12.5. The Customer should package returned goods in a manner that reasonably protects them from damage during return transportation.

13. CONDITION OF RETURNED GOODS

13.1. The Consumer may inspect and handle the goods only to the extent necessary to establish their nature, characteristics and functioning in a manner comparable to what would reasonably be possible in a physical store.

13.2. The Consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

13.3. YEESTHIN will not automatically refuse a full refund solely because the external packaging has been opened or damaged where the Consumer retains a statutory right of withdrawal.

13.4. The provisions concerning diminished value do not affect circumstances in which the statutory right of withdrawal is excluded after a particular sealed product has been unsealed for health protection or hygiene reasons.

14. REFUNDS

14.1. Where the Consumer validly exercises the right of withdrawal, YEESTHIN will reimburse all payments that must be reimbursed under applicable law, including the cost of the standard initial delivery where applicable.

14.2. If the Consumer expressly selected a delivery method more expensive than the least expensive standard delivery method offered by YEESTHIN, the additional cost difference will not be refunded to the extent permitted by law.

14.3. Refunds will be made without undue delay and within the period prescribed by applicable law.

14.4. YEESTHIN may withhold reimbursement until the goods have been received back or until the Consumer provides evidence that the goods have been sent back, whichever occurs first, where permitted by law.

14.5. Refunds will generally be made using the same means of payment used for the original transaction unless the Consumer has expressly agreed otherwise and provided that the Consumer does not incur additional fees as a result.

15. INCORRECT, DAMAGED OR NON-CONFORMING PRODUCTS

15.1. Customers should notify YEESTHIN as soon as reasonably possible if they receive:

  • a product different from the one ordered;
  • a damaged product;
  • an incomplete order;
  • a product with visibly compromised integrity;
  • a product that does not conform to the contract.

15.2. To facilitate the handling of the claim, YEESTHIN may request the order number, a description of the issue and appropriate photographic evidence.

15.3. The request for photographs is intended to facilitate investigation of the claim and does not restrict the Consumer's statutory rights.

15.4. In the event of established non-conformity, the Customer is entitled to the remedies provided by applicable law, including, where applicable, bringing the goods into conformity, replacement, a proportionate reduction in price or termination of the contract.

16. STATUTORY LIABILITY FOR CONFORMITY

16.1. YEESTHIN is responsible for the conformity of goods sold in accordance with applicable consumer protection legislation.

16.2. For consumer sales within the European Union, the statutory period of liability for lack of conformity provided by applicable law applies and may not be shorter than the minimum protection established under EU law.

16.3. Nothing in these Terms and Conditions limits the Consumer's statutory rights in relation to non-conforming goods.

16.4. Any voluntary commercial guarantee does not restrict or replace the Consumer's statutory rights.

17. TEA, FOOD PRODUCTS AND ALLERGENS

17.1. For food products offered for sale, YEESTHIN provides the information required under applicable food information legislation.

17.2. Customers should review the ingredients, allergen information, preparation instructions and storage conditions before use.

17.3. Product information should not be regarded as a substitute for professional medical advice.

17.4. In the case of a known allergy or intolerance, pregnancy, use of medication or another circumstance in which the consumption of particular herbs or ingredients may be relevant, the Customer should seek appropriate professional medical advice where necessary.

17.5. YEESTHIN shall not be liable for harm caused solely by use of a product contrary to clearly provided instructions or warnings, except where applicable law provides otherwise.

18. COSMETIC PRODUCTS

18.1. Customers should use cosmetic products in accordance with their intended purpose and the instructions provided.

18.2. Ingredients of cosmetic products are stated on the packaging and/or in the relevant product information in accordance with applicable legislation.

18.3. Customers with known sensitivities or allergies should carefully review the ingredients before use.

18.4. If an adverse reaction occurs, use of the product should be discontinued and medical assistance sought where appropriate.

18.5. Nothing in this section limits any statutory liability of YEESTHIN or another responsible person where such liability cannot lawfully be excluded.

19. PROMOTIONS AND DISCOUNT CODES

19.1. YEESTHIN may periodically offer promotions, bundles, gifts and discount codes.

19.2. Specific promotions may be subject to additional conditions, validity periods, minimum order values or restrictions relating to particular products.

19.3. Unless expressly stated otherwise, promotional codes may not be combined.

19.4. Promotional terms do not restrict Consumers' statutory rights.

20. INTELLECTUAL PROPERTY

20.1. The content of www.yeesthin.com, including trademarks, trade names, logos, images, photographs, videos, graphics, texts, designs and other materials, is protected by applicable intellectual property laws.

20.2. Such content may not be copied, reproduced, distributed, modified or used for commercial purposes without prior authorisation from the relevant rights holder, except where permitted by law.

20.3. Purchasing a product does not grant the Customer any rights to YEESTHIN trademarks, designs, photographs or other intellectual property.

21. PERSONAL DATA

21.1. YEESTHIN processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable data protection legislation.

21.2. Personal data necessary to accept, process, deliver and administer an order may be processed on the basis of performance of the contract and/or compliance with a legal obligation.

21.3. Personal data may be provided to payment, logistics, technology and other service providers where necessary and where an appropriate legal basis exists.

21.4. Completion of an order is not conditional upon consent to receive marketing communications, except where applicable legislation provides for a specific lawful exception.

21.5. Detailed information regarding the processing of personal data, retention periods, recipients and data subject rights is provided in YEESTHIN's separate Privacy Policy.

22. MARKETING COMMUNICATIONS

22.1. Electronic marketing communications will be sent where an appropriate legal basis exists under applicable law.

22.2. Where marketing is based on consent, the Customer may withdraw that consent at any time.

22.3. Where applicable, each electronic marketing communication will provide an easy means of opting out of future communications.

22.4. Opting out of marketing communications does not affect transactional communications necessary for processing an order, delivery, payment, complaint, return or other contractual matter.

23. LIABILITY

23.1. YEESTHIN is responsible for performing its obligations under the contract and applicable law.

23.2. Nothing in these Terms and Conditions excludes or limits liability that cannot lawfully be excluded or limited.

23.3. YEESTHIN shall not be liable for damage resulting from improper use of a product, failure to follow instructions or warnings, or use for purposes other than those intended, to the extent that the damage is not caused by a defect, non-conformity or another circumstance for which YEESTHIN is legally responsible.

23.4. YEESTHIN shall not be liable for temporary unavailability of the Website resulting from maintenance, infrastructure failure, communication network disruption or other circumstances outside the reasonable control of the company.

23.5. The limitations of liability in this section do not affect mandatory consumer rights.

24. FORCE MAJEURE

24.1. YEESTHIN shall not be liable for failure or delay in performing its obligations where such failure or delay results from extraordinary and unforeseeable circumstances beyond its reasonable control and whose consequences could not reasonably have been avoided.

24.2. Such circumstances may include natural disasters, war, civil unrest, actions of public authorities, major disruptions to transport or communication systems and comparable events.

24.3. This section does not restrict any Consumer rights that remain applicable by law in such circumstances.

25. COMPLAINTS

25.1. Customers may submit complaints and claims to:

25.2. To facilitate efficient handling, Customers are encouraged to provide their order number, contact information and a clear description of the issue.

25.3. YEESTHIN will handle complaints within a reasonable period and in accordance with applicable law.

25.4. The parties are encouraged to first attempt to resolve any dispute through direct communication.

26. ALTERNATIVE CONSUMER DISPUTE RESOLUTION

26.1. Consumers may have the right to use a competent alternative dispute resolution body in accordance with applicable national and European Union legislation.

26.2. Where YEESTHIN is required or has committed to use a specific alternative dispute resolution body, the relevant information will be provided to the Consumer in accordance with applicable legal requirements.

26.3. The European Online Dispute Resolution (ODR) platform established under Regulation (EU) No 524/2013 has been discontinued and therefore these Terms and Conditions do not contain a link to that platform.

27. APPLICABLE LAW

27.1. Contracts concluded with YEESTHIN are governed by Bulgarian law to the extent permitted under applicable European Union law.

27.2. The choice of Bulgarian law does not deprive a Consumer habitually resident in another country of the protection afforded by mandatory provisions of the law that would apply in the absence of such choice.

27.3. Nothing in these Terms and Conditions limits a Consumer's right to bring proceedings before a competent court where such right is provided by applicable law.

28. CHANGES TO THESE TERMS AND CONDITIONS

28.1. YEESTHIN may periodically amend these Terms and Conditions due to changes in legislation, business operations, products, payment methods, delivery arrangements or Website functionality.

28.2. The current version will be published on www.yeesthin.com together with the date of the latest update.

28.3. Each order is governed by the Terms and Conditions in force at the time the relevant contract is concluded, unless otherwise required by law.

29. SEVERABILITY

29.1. If any provision of these Terms and Conditions is found to be invalid, unenforceable or unlawful, this shall not affect the validity of the remaining provisions.

29.2. The invalid provision shall, to the maximum extent permitted by law, be replaced or interpreted in a manner that most closely reflects its lawful purpose.
